Pom Poms and Paint and Data Protection

Pom Poms and Paint is committed to the safeguarding of children and requires your consent to use images of yourself or your child.

We would occasionally like to take photographs/videos within our sessions to be used for general publicity. This would mean that the images will be used on the Pom Poms and Paint website or other websites where we advertise the Company, Social Media sites, printed publications, newsletters, exhibition materials and also in submission to magazines and newspapers (local or national).

Pom Poms and Paint cannot accept any liability for any loss, damage or personal injury, howsoever caused, through the use of the image by third parties.

Websites can be seen globally and no warranty can be given that adequate data protection legislation will apply outside of the UK. 

Pom Poms and Paint will store these images indefinitely on file but will not keep or supply any personal details such as a persons name or age when using these images.

You may withdraw your consent at any time by writing to Pom Poms and Paint, Warwick Lane, 3-4 The Square, Wickham, PO17 5JN. However you must understand that images that have been previously used with your consent may still be in circulation and not withdrawn.

Your Responsibility

We understand that you may wish to take a photo or video recording of your child in the shop. We ask that you do so in a way that recognises other people's right to privacy.

You must take care to ensure that only your child’s image is captured.

You must not take photographs and/or video footage of anyone else’s child unless you have prior agreement from the parent/guardian of other children.

If asked to stop filming or taking photographs then you must do so immediately.

If you are concerned that your child may be being filmed or photographed by another customer without your permission then you have the right to ask them to stop. Please approach the parent yourself if possible but speak to the session leader if you continue to have any concerns.

Pom Poms and Paint cannot be held liable for the actions of third parties i.e. non-Pom Poms and Paint customers and session leaders or neighbouring shop owners, and, therefore, excludes to the fullest extent possible by law, any liability arising from a breach of this section headed ‘Photography and Video Policy’ by any third party.

Anyone found to be in serious breach of the above terms may be asked to leave the session immediately and no refund will be offered.

The decision of the session leader is final.
